Andrew V. Cobbe is a Florida Bar Board Certified Construction Lawyer and a licensed Florida Certified Roofing Contractor (CCC1327905). He counsels roofing contractors on the contracts, licensing, payment, and warranty issues that come with working under Florida's building code and insurance environment.
Services include customer, general contractor, and subcontract agreements; lien rights, payment bond claims, and collections; warranty terms and manufacturer warranty coordination; DBPR, licensing, and qualifier issues; and Chapter 558 construction defect notices and defense.
Roofing work in Miami-Dade and Broward counties falls under the High-Velocity Hurricane Zone provisions of the Florida Building Code, along with product approval and permitting requirements. Florida law also restricts how contractors may advertise and interact with property insurance claims, including section 489.147, Florida Statutes, and recent limits on assignment of benefits. Contracts and sales practices that were common a few years ago can now create real exposure.
For residential and commercial property insurance policies issued on or after January 1, 2023, Florida law generally no longer allows post-loss assignment of benefits to contractors. Older policies and specific facts can change the answer, so have your contract forms reviewed.
