Construction Mediation, Arbitration and ADR

A Neutral Who Understands the Technical Questions

Construction disputes are often decided by technical questions: what the plans required, what the schedule shows, whether the roof was installed to specification. Andrew V. Cobbe is Board Certified by The Florida Bar in Construction Law and holds licenses as a Florida Certified General Contractor and Certified Roofing Contractor. He is available to serve as a party-selected mediator, arbitrator, or Initial Decision Maker under AIA contract documents. Andrew is not a Florida Supreme Court Certified Mediator; mediation services are offered where the parties select him by agreement.

Neutral Services

  • Private mediation, by agreement of the parties, of construction payment, delay, and defect disputes
  • Arbitration under AAA construction rules or private agreement
  • Serving as Initial Decision Maker under AIA A201 and related documents
  • Project-level dispute resolution before claims escalate

FAQ: What is the difference between mediation and arbitration?

In mediation, a neutral helps the parties reach their own settlement, and nothing is decided unless everyone agrees. In arbitration, the arbitrator hears the evidence and issues a binding decision.

FAQ: What is an Initial Decision Maker under an AIA contract?

The AIA A201 General Conditions let the parties name an Initial Decision Maker to issue first-level decisions on claims before mediation or arbitration. If no one is named, the architect usually fills that role.

FAQ: Why choose a construction-specific neutral?

A neutral with construction training can grasp scheduling, scope, and means-and-methods issues quickly, which can save the parties time and expense.
